1. Grant of Rights to the Client
- Upon delivery of the commissioned artwork ("Artwork"), the Client is granted the following rights:
- The right to display, print, and share the Artwork for personal enjoyment.
- The right to commission a limited number of unique, niche products based on the Artwork for personal, non-commercial use. These commissioned pieces should not be for sale or distributed in any commercial capacity and are intended solely for the Client’s personal enjoyment or display.
2. Retention of Rights by the Artist
- The Artist retains full copyright and intellectual property rights to the Artwork. This includes the exclusive right to reproduce, modify, distribute, and display the Artwork for commercial purposes, including but not limited to creating merchandise for sale in the Artist’s online store.
- The Artist retains the right to license, distribute, and display the Artwork in any form or media, including physical products and digital content.
3. Restrictions on Use by the Client
- The Client agrees not to use the Artwork for any commercial purposes beyond the specific non-commercial, personal-use commissions outlined in Section 1 without prior written permission from the Artist.
- The Client may not reproduce, distribute, or sell copies of the Artwork or use the Artwork in any way that could compete with the Artist’s commercial interests, unless expressly agreed to in writing by the Artist.
4. Care of Digital Files
- The Client is encouraged to create backup copies of any digital files provided by the Artist. The Artist is not responsible for the preservation or quality of digital files beyond the initial delivery.
5. Trademark and Copyright Notice
- The Artist's copyright notice must remain intact on any reproduction of the Artwork unless expressly permitted otherwise in writing by the Artist.
- All rights to the trademark, logo, and signature of the Artist are reserved and protected under applicable intellectual property law.
6. Liability
- The Artist is not liable for any damages or loss associated with the improper handling, storage, or reproduction of the Artwork by the Client or any third parties.
7. Entire Agreement
- This Agreement represents the entire understanding between the parties and supersedes all prior agreements, negotiations, or understandings.
8. Revision Policy
- The Artist will provide one complimentary revision of the Artwork based on the Client’s feedback, if requested.
- Any additional redesign requests after the initial revision will incur a fee of $10 per redesign. Redesigns include, but are not limited to, adjustments to color, concept, text, or other elements as specified by the Client.
- The Client will be invoiced for each additional redesign, and payment must be received before further work on the revisions proceeds.
9. Rush Order Policy
- If the Client requires the Artwork to be completed within a shortened timeframe (e.g., 1-3 business days), a rush fee will apply. The specific fee will be determined based on the required delivery date and the complexity of the Artwork.
- The rush fee is in addition to the original commission price and must be agreed upon by both parties before work begins.
- Rush orders will only be accepted if the Artist’s schedule allows, and the Artist reserves the right to decline rush requests if they cannot be accommodated.
